Pdf Summary
Following a reported motor carrier accident, the Safety Director should first confirm that the driver and public are safe, verify that emergency services were contacted, and ensure the scene is secured with warning devices as required. The driver should avoid discussing fault. Company leadership and legal counsel should be notified.

Support the driver in documenting the scene, vehicles, witnesses, and road and weather conditions. Preserve electronic logging device, dashcam, and telematics data, and obtain a written driver statement.

Determine whether FMCSA post-accident testing is required under 49 CFR 382.303. When required, conduct alcohol testing within two hours (and no later than eight hours) and drug testing within 32 hours. Document any efforts if testing cannot be completed on time.

Complete or update the accident register under 49 CFR 390.15 and gather relevant records, including police and medical reports, repair documentation, and insurance information. Retain records for at least one year, or longer when required.

Remove any damaged or unsafe vehicle from service and conduct inspections as needed. Review the driver’s hours-of-service records, CDL and endorsements, medical card, and qualification file. Notify the insurer with factual information only, and route official communications through an authorized spokesperson. Consult legal counsel for serious or fatal accidents and hazardous-material releases.

Finally, investigate the accident, assess preventability and potential safety-rule violations, and document findings and corrective actions, such as retraining, policy changes, or discipline.
