Video Summary
TCA’s Executive Leadership Series webinar reviewed major legal and regulatory issues affecting trucking and logistics.

The speakers discussed independent-contractor classification, highlighting that courts use fact-specific, multi-factor tests. Business ownership, control over accepting loads, investment in equipment, and whether vehicles are dedicated to business use can all affect outcomes. They noted that misclassification litigation remains prevalent.

California emissions rules—including the Advanced Clean Trucks and Omnibus regulations—are influencing truck availability and manufacturer sales policies, while similar rules have been adopted by other states. EPA’s greenhouse-gas standards also encourage fleet electrification. Legal challenges and uncertainty over enforcement remain significant.

Other topics included New Jersey’s higher insurance minimums for certain heavy vehicles; the transportation-worker exemption to federal arbitration law, with business-entity contracts potentially supporting enforceable arbitration agreements; and biometric privacy compliance, especially for fingerprints, timekeeping, and in-cab technology.

The presenters also covered conflicting federal court rulings on whether federal law preempts negligence claims against freight brokers, the effects of the Supreme Court’s reversal of Chevron deference, and legislative efforts to curb predatory towing practices. They noted that the FTC’s non-compete ban had been blocked by courts, and that federal preemption of California and Washington meal-and-rest-break rules could change if FMCSA grants pending waiver requests.

The webinar emphasized monitoring evolving laws, reviewing contracts and data practices, and preparing for continued litigation and regulatory uncertainty.
