Online Leadership Series - Predatory Towing-Online Leadership Series

Video Transcription

Video Summary

Alex Miller, president and CEO of the Florida Trucking Association, discussed predatory towing practices and efforts to address them. Drawing on ATRI research and examples of extreme towing bills, she described tactics including cash-only demands, “hook and hold” practices, booting, excessive labor and storage charges, poor recordkeeping, and inadequate notice when vehicles are towed or sold. She noted that out-of-state carriers may be especially vulnerable because they often lack knowledge of local rules or clear avenues for recourse.

Miller outlined recent legislation in Tennessee, Mississippi, Colorado, North Carolina, and Florida. Florida’s 2024 law, for example, requires posted maximum rates, itemized invoices, multiple payment options, access to cargo, and better notice and record retention. She cautioned that laws alone are not enough: outdated regulations, inconsistent local rates, and limited law-enforcement awareness can impede enforcement.

To protect their businesses, carriers should report incidents, educate drivers not to sign agreements without approval, document towing and recovery activity, contact local law enforcement, build relationships with reputable towing companies, and seek help from state trucking associations. She emphasized that survey responses and industry advocacy provide the evidence needed to drive effective change.
